GENERAL TERMS AND CONDITIONS Kusje erop EHBO [11-11-2024]

If and when there are differences between this translation in English compared to the original Dutch version, the conditions of the Dutch version will always be leading.

 

1. Applicability

These general conditions apply to every offer, quotation and agreement relating to by Kusje erop EHBO established in Eindhoven (KVK number 74304283), to deliver products and services of any kind, unless otherwise expressly agreed in writing.

Deviation from these conditions is only possible if the parties have expressly agreed in writing.

Kusje erop EHBO has the right to change these General Conditions from time to time. The amended conditions will apply as soon as they are published on the website of Kusje erop EHBO. When a customer places an order via email, Kusje erop EHBO website or the Red Cross webshop, the customer thereby accepts the applicability of the amended General Terms and Conditions.

2. Definitions

Kusje erop EHBO: the one-man business Kusje erop EHBO which offers first aid and BHV courses and workshops to companies and private individuals via the webshop of the Netherlands Red Cross, on www.kusjeeropehbo.nl, on www.firstaideindhoven.nl, on www.beleefbhv.nl and via social media.

Customer: every (legal) person who registers for a course organized by Kusje erop EHBO. Registration can be done through the Red Cross webshop, by email, through the contact form at www.kusjeeropehbo.nl and at www.firstaideindhoven , through Facebook, Facebook Messenger or WhatsApp. It is not possible to register for a course on the spot.

Customers also include: companies, associations, groups etc. who have a course (on location) provided by Kusje erop EHBO via EHBO on location / the B2B form of the Red Cross, or via Kusje erop EHBO.

Course: all courses and workshops or any other meeting provided by Kusje Erop EHBO with the aim of transferring and/or increasing knowledge and/or skills.

Instructor: the person who provides the course on behalf of Kusje erop EHBO. The instructor is at least certified by the Red Cross and if necessary by the Orange Cross and / or the Dutch Resuscitation Council.

Group training: a course for a group of people without open registration on a date scheduled in consultation. This also includes InCompany training and private courses. The course can take place on location of Kusje erop EHBO or on a location provided by the customer.

3. Terms of payment

All prices as mentioned on the website of Kusje erop EHBO and the webshop of the Red Cross are including VAT unless otherwise stated. Kusje erop EHBO reserves the right to change prices at all times. Price changes do not apply to closed agreements.

Courses are inclusive of 21%BTW, dressing materials and books are inclusive of 9% VAT unless otherwise stated.

By registering for a Red Cross First Aid course, the customer enters into a payment obligation with Kusje erop EHBO.

Within 2 weeks of registration it is possible to cancel the course without charge. This falls under the right of withdrawal.

The right of withdrawal expires if the e-learning has started in Heartbeat or if the course takes place within 2 weeks.

For individual registrations, payment should be made as soon as possible, but always within 1 week of the invoice date. For registrations less than 7 days prior to the course, the invoice must be paid prior to the course. If the invoice is not paid on time, Kusje erop EHBO has the right to deregister the student for the course.

For group trainings, the invoice for the course will be sent after completion of the course, unless otherwise agreed in advance. We apply a payment term of 30 days, unless otherwise agreed in advance.

The customer’s financial obligation to Kusje erop EHBO does not expire by not attending the (full) course. If the course has not yet been paid, it must still be paid.

4. Cancellation

1. Cancellation by Kusje erop EHBO

Kusje erop EHBO has the right without giving any reason to cancel the course, change the date or refuse participation of a student, in which cases the right arises to repayment of the full amount paid to Kusje erop EHBO. Excluded from refund are situations as described under 4.2.

Kusje erop EHBO will (except force majeure situations) at least 7 days before the start of the course notify the student about the cancellation.

If a course is cancelled due to insufficient enrollment, an attempt will be made at all times to move the registered student to (an) other date(s). If a suitable date is not found within 3 months, the registration will be canceled and the course participant will receive a refund of the registration fee.

2. Obligations for the student

It is not allowed to use or be under the influence of alcohol or drugs during the course. A course participant’s behavior must not interfere with the normal course.

Pets and children < 12 years old are not allowed during the course. In the case of an on-site course, pets may not run loose in the place where the course is held.

For an on-site course, the location must be safe. There must be sufficient space at the training location to be able to perform the actions to be practiced. As a guideline, there must be at least 3×3 m2 of free floor space per 3 students.

For a course with e-learning, the student must have completed the e-learning before the start of the course.

The student shall arrive at the course on time. Latecomers cannot be admitted, even in cases of force majeure.

If the above obligations are not met, the student will be refused admission to the course or asked to leave the course. In the case of an on-site course, the instructor will leave the location. In these cases there is no right to a refund of course fees or free transfer to a course at another time.

It is only possible to take a complete course. Certificates of courses / FAFS training taken elsewhere do not entitle you to exemption from certain parts. For multi-day courses, it is not possible to follow a subsequent course day if the preceding course day(s) have not been completed.

3. Cancellation by the student for courses with individual enrolment

Cancellations must always be made by e-mail. Cancellations by phone will be confirmed by mail. In case of cancellation, the customer always has to pay an administration fee of €35,- incl. VAT.

Moving to another date can be done once free of charge up to 1 month prior to the course. In case of multiple transfers, a €35 administration fee will be charged.

Changes within 1 month prior to the course will be considered as cancellation + re-registration with corresponding costs.

For cancellations up to 1 month before the first course day, there is a €35 administration fee (incl. VAT) and a full refund of the course fee.

If cancelled up to 1 week before the first course day, one is entitled to a 50% refund of the course fee. From this €35 administration fee (incl. VAT) will be deducted. For courses up to €70 there will be no refund.

For cancellations within 1 week before the start of the course there is no right to a refund.

When canceling a course with e-learning, the costs made by Kusje erop EHBO for the e-learning will be charged if the right of withdrawal has expired.

For both individuals and companies, a student can be replaced by another student free of charge. However, any e-learning must be repurchased. Students arrange payment of the course fee among themselves. If the new student would like a new invoice, an administration fee of €35 will be charged. In that case Kusje erop EHBO will return the course fee to the original student.

In case of force majeure Kusje erop EHBO decides on a possible free transfer or refund of course fees. In case of force majeure (to be judged by Kusje erop EHBO) is one time free transfer possible. In case of repeated force majeure, the course must be rebooked.

5. Group Training

1. General

Group training can be booked via Kusje erop EHBO (email, website, social media etc) and via First Aid on location from the Red Cross. In case of a request for first aid on location (B2B form) with the Red Cross, the Red Cross forwards the request to Kusje erop EHBO. When the customer agrees to Kusje erop EHBO’s offer, the customer no longer counts as a Red Cross customer, but as a customer of Kusje erop EHBO.

For courses booked directly through Kusje erop EHBO the prices apply as stated on the websites of Kusje erop EHBO or as agreed with the customer.

For courses booked through Red Cross First Aid on location the prices for individual students apply.  The discount as mentioned on the website is in this case not applicable unless otherwise agreed.

For a course where a price per person is paid, a minimum number of participants of 8 persons applies. For courses there is a maximum of 12 students per group.

The invoice for a group training course will be issued retrospectively based on the previously agreed number of course participants. If more students participate than previously agreed upon, the costs for these student(s) will be added to the invoice.

If a student does not participate in the course, there is no refund for that student’s course fee. If there are multiple trainings for 1 customer, the student can participate in another training if there is a place left there. It is not possible to catch up the course at another time (except when rebooking a course) or to join the same course with open enrollment.

It is possible to replace a student with another student at any time. However, any e-learning must be purchased again. No costs are charged for one-time changes. For multiple changes, €35 administration costs are charged per change. Per change, several students can be replaced / exchanged.

2. Cancellation / change by the customer for group training

Cancellations / changes should always be made by email. Cancellations / changes by phone will be confirmed by mail.

In case of change or cancellation regardless of the reason, the following costs will be charged.

For group trainings, the group price or the minimum number of participants will always be charged.

Cancellation policy:     Due

Cancellation > 14 days* 0%

Cancellation > 7-14 days* 50%

Cancel > 1-7 days* 100%

Absent without cancellation or cancellation on class day itself 100%

* if remitted, the cost of the textbook or e-learning will be charged.

 

6. Certificates

The instructor assesses whether the student is competent. If this is not the case, an attempt will be made to achieve competence during the lesson(s). If this is not successful, it is possible to take an additional class at an additional cost. If the instructor judges that the student is not competent, the student will not be given a certificate. Failure to issue a certificate does not entitle the student to a refund of the course fee.

7. Purchase of bandage material.

Bandaging material can be purchased during or after the course directly from Kusje erop EHBO’s instructor.

If insufficient bandage material is available, Kusje erop EHBO will try to deliver the bandage material to the customer personally. If this is not possible, the material will be sent by mail and the shipping costs will be charged to the customer unless otherwise agreed.

Dressing materials purchased during or after the course up to an amount of €50 cannot be returned or exchanged. For purchases with a value of €50 or more, a cooling-off period of 14 days applies. If the customer wishes to return the product, the product must be unopened and undamaged. Any shipping costs for returns are to be paid by the customer.

Products with the logo of Kusje erop EHBO may not be resold to third parties.

8. Privacy

Data as provided at registration will be stored by Kusje erop EHBO for up to 3 years. After these 3 years, the data will be anonymized or destroyed. Contact data will be used to offer students a course for repetition, extension or deepening after 1 and 2 years.

Data is shared with the Red Cross, the Dutch Resuscitation Council (NRR) and the Orange Cross if necessary for certification.

9. Liability

Kusje erop EHBO is not liable for any damage caused by or related to participation in a course, unless Kusje erop EHBO can be blamed for intent or gross negligence.
